General Terms and Conditions for the sale, payment and shipment & delivery of products and services by ARISTI Authentic Handmade Jewels.
“ARISTI Jewels” means ARISTI Authentic Handmade Jewels, registered at Van de Spiegelstraat 15a, 2518 ES The Hague, The Netherlands, chamber of commerce number: 67880525, VAT: NL002508285B27;
“Customer” means the person who enters into an agreement with ARISTI Jewels;
“Day” means calendar day;
“General Terms and Conditions” means this document.
These General Terms and Conditions apply to
- every offer made by ARISTI Jewels and every agreement realised between ARISTI Jewels and a Customer. If such agreement is concluded electronically through ARISTI Jewels website – www.aristijewels.com – then Customer will be provided with these General Terms and Conditions electronically and Customer shall agree to them before the agreement is entered into.
An agreement is concluded at the moment that Customer; i) accepts a product offer from ARISTI Jewels and the General Terms and Conditions, and ii) has paid the total corresponding price. If Customer accepts the offer electronically, ARISTI Jewels shall acknowledge the acceptance of the offer with an electronic receipt.
Shipment and Delivery
Shipment costs to various destinations are mentioned on ARISTI Jewels’ website. If you place an order, the specific shipment costs for your order will be mentioned before you place the order.
The risk of damage and/or loss of products up to the moment of delivery to Customer or his representative is borne by ARISTI Jewels. From the moment of delivery, the risk of damage and/or loss is borne by Customer.
All products are delivered duty unpaid. Any and all customs, import or other duties that are charged once a product reaches the destination country shall be paid by customer.
Withdrawal and Return
Customer has the right to withdraw and return a product within 14 days from the date of receipt. Returned products must be in their original state in which Customer received them and may not have been used, worn or damaged. Customer shall return products in their original state, including all original documents, and pack the product properly. Return shipment costs shall be borne by Customer.
If a returned product is received in its original state and accepted by ARISTI Jewels, it shall refund the product’s purchasing price to Customer.
If Customer and/or products received by ARISTI Jewels don’t comply with the terms in this section 5 and/or the terms mentioned in the section “POLICY” in the website, then the products shall not be shipped back to Customer and the payment shall not be refunded.
Images, drawings, measurements, descriptions and statements of products are reasonably accurate, but not strictly binding. Reasonable deviations are permissible without Customer being allowed to derive any rights.
ARISTI Jewels offers a six months period limited warranty from the date of receipt against defects in material and/or workmanship on its products. In order to exercise such warranty right, Customer must send an email to email@example.com explaining his request and submit the original proof of purchase and a photo of the defective product. If ARISTI Jewels agrees that a defect in material and/or workmanship for the warranty period applies, it may at its sole discretion decide to repair a defective product or to refund the price Customer paid for the product including the delivery charges.
Except as expressly set forth in these General Terms and Conditions, no other warranties are provided, including but not limited to depreciation or deterioration resulting from wear and tear, accident, alteration, repair or other use.
Limitation of Liability
To the maximum extent permitted by law, ARISTI Jewels is not liable for any indirect, consequential, incidental, special or punitive damages, including but not limited to lost profits, lost revenue, lost data, lost savings, lost business and loss of goodwill. To the maximum extent permitted by law, ARISTI Jewels liability in any circumstance is limited to the amount paid by Customer to ARISTI Jewels.
ARISTI Jewels is not liable for any failure by ARISTI Jewels, by its representatives or the company shipping its products, to perform their obligations if such failure is due to acts, events or circumstances beyond their reasonable control (“Force Majeure Event”), including but not limited to strike, civil commotion, riot, invasion, terrorist attack, war, fire, explosion, storm, flood, earthquake, natural disaster, impossibility to use railways, ships, aircraft, lorries or other means of transport, and impossibility to use telecommunications networks.
ARISTI Jewels performance is deemed to be suspended for the period that the Force Majeure Event continues. ARISTI Jewels shall use reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which its obligations under the agreement may be performed despite the Force Majeure Event.
ARISTI Jewels reserves the right to change these General Terms and Conditions and any other terms and procedures at any time without providing notice thereof. The amended General Terms and Conditions and any other amended terms and procedures shall be effective from the moment that ARISTI Jewels posts the same on its website.
Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of The Netherlands without reference to a conflict of law provisions and with the exclusion of the Convention on the International Sale of Goods. Disputes between ARISTI Jewels and Customer shall be submitted exclusively to the jurisdiction of the courts of Amsterdam, The Netherlands.
